THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7540 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 to 3 seeking anticipatory bail in the event of their arrest in connection with Crime.No.56 of 2023 on the file of Itikyal Police Station, Jogulamba Gadwal District, registered for the offences under Sections 419, 420, 467, 468, 471 r/w 34 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The de facto complainant case is that these petitioners have colluded and having forged Aadhar Card of one Kuruva Venkatanna got registered gift deed bearing No.6792/2018 in the Sub-Registrar Office on 23.05.2018. Since the documents were fabricated and gift deed was registered in favour of petitioner No.1, the complaint was filed.

Even, according to complaint, the alleged documents are available in the Sub-Registrar Office. In the said

circumstances, when the transaction is of the year 2018, this Court deems it appropriate to grant relief of anticipatory bail to the petitioners subject to the following conditions;-

1) The petitioners/Accused Nos.1 to 3 are directed to surrender before the Station House Officer, Itikyal Mandal, Jogulamba Gadwal District on 21.08.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.1 to 3 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused No.1 shall appear before the concerned police as and when required for the purpose of investigation.

3) On such release, the petitioners/Accused Nos.2 and 3 shall appear before the concerned police on every day at 10.00 a.m from 21.08.2023 to 31.08.2023.

4) The petitioners/Accused Nos.1 to 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

5) The Investigating Officer shall obtain the specimen signatures of the petitioners/accused Nos.1 to 3 for

sending the same to the Handwriting Expert for the purpose of comparison with the documents, if necessary during the course of trial.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
