ORDER

Challenging the action of the 3rd respondent in calling the petitioner to the police station, the present writ petition is filed. Learned Government Pleader has produced written instructions received from the Sub Inspector of Police, Chandanagar Police Station, which reads as under: "One Smt Mangalagiri Swathi (wife of the petitioner herein) has approached the Police of Chandanagar Police Station, Cyberabad Commissionerate and lodged a complaint on 7.12.2016 stating that she got married with one Nehru Chary (petitioner herein) on 25.1.

2015 and at the time of marriage her parents gave the money of 15 lakhs cash, 25 tulas of gold and other house hold articles and after one day of their marriage she came to know that the petitioner is having illegal affair with one another woman and since then the petitioner started harassing her both mentally and physically by demanding to bring additional dowry and one Mr.Tarakachary who is the younger brother (babai) is supporting the petitioner and hence requested the police to take necessary action. Basing on contents of the above complaint, a case in Cr.No.574/2016 U/secs.498-A IPC and Secs.3 and 4 of DP Act was registered on the file of Chandanagar Police Station on 7.12.2016 and investigation was taken up.

The petitioner herein is shown as A1 in the FIR. It is pertinent to submit that the investigation is at the initial stage. On coming to know the lodging of complaint against him by his wife, the petitioner on mere apprehension and to prove the police from taking any action in the event lodging of any complaint, rushed to this Hon'ble Court and filed the present writ petition with false and concocted allegations.

I humbly submit that action was taken depending on the evidence adduced during the course of investigation against the petitioner herein by following the due procedure." In view of the same, no further orders are necessary in the present writ petition.
