THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24381 OF 2017 ORDER:

The writ petition is filed questioning the action of the 2nd respondent in not completing the investigation in Crime No.57 of 2014 on the file of 3rd respondent for the offences under Section 3(3)(v) of SCs & STs (POA) Act, 1989 and Section 120(b), 420, 465, 467, 468, 471 read with Section 34 IPC as illegal and arbitrary. When the matter is taken up for hearing, learned Government Pleader for Home has placed on record the written instructions received from the Deputy Superintendent of Police, SC/ST-Cell, Visakhapatnam District, which reads as under:

"Investigation done and evidence established that there is a land dispute at about Acs.22.65 cents in Sy.No.64 of Sambuvanipalem Villagoe, Devarapalli Mandal. Further, there is Civil suits pending in Chodavaram Court. In this connection, the Dy. Superintendent of Police also obtained copies of Adangal through online from the Tahsildar, Devarapalli in which it is stated that the A-1 Dogga Sannibabu has possession of land to the extent of Ac.1.00 cents and he had also obtained legal opinion in which he got that the provisions of atrocity are not attracted and mentioned that the case is purely civil in nature." In the light of the above, the investigation shall be completed within a period of six weeks from the date of receipt of copy of the order and necessary report be filed before the competent court. Subject to the above, the writ petition is disposed of.

Miscellaneous Petitions, if any pending in this writ petition, shall also stand closed. No order as to costs.
