HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16070 OF 2015 ORDER:

With the consent of learned counsel for the petitioner and learned Government Pleader for respondents, this writ petition is disposed of at the admission stage.

2. This writ petition is filed by the petitioner apprehending demolition of her house bearing Door No.9-245 situated at Dowleswaram Village, Rajahmundry Rural Mandal, East Godavari District, by the respondents for widening of the road. Road markings are made on the compound wall of the building, to the extent of which demolition required to be made. No notice was issued nor procedure as contemplated by law was followed for acquiring the property of the petitioner for widening the road. The property of the petitioner is private owned property.

3. Learned Government Pleader, on instructions, submits that respondents shall follow due process of law before taking action of the demolition of the private properties.

4. Having regard to the said submissions, the writ petition is disposed of directing the respondents to follow due process of law before acquiring the property of the petitioner for the purpose of widening of the road passing

through the property of the petitioner situated in Dowleswaram Village, Rajahmundry Rural Mandal, East Godavari District. Miscellaneous petitions if any pending in the writ petition shall stand closed. ____________________________ JUSTICE P.NAVEEN RAO Note:
