Kothapally Rajaiah v. Pinna Linganna
SMT JUSTI CE T. RAJANI SECOND APPEAL No.6 6 4 of 2 0 1 8 JUDGMENT:
This second appeal is preferred against the judgment, dated 23.02.2018, passed by the Chairman (MA.C.T.) II Additional District Judge, (FTC), Mancherial, in A.S.No.11 of 2015, which has confirmed the judgment, dated 09.06.2015, passed by the Principal Senior Civil Judge, Mancherial in O.S.No.169 of 2009.
2.
Admittedly, the suit is filed seeking for a decree against the defendants herein for a sum of Rs.4,56,000/ -. A perusal of the judgment shows that, the written statement of the defendant was considered, as against the ground in the appeal, that it is not considered. The defendant did not examine himself or anyone on his behalf and did not even adduce any documentary evidence. In those circumstances, both the Courts below decreed the suit in favour of the plaintiff. There are absolutely no substantial questions of law involved in the appeal. The three questions of law framed by the appellant do not involve any substantial questions of law.
Accordingly, the Second Appeal is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs. _ _ _ _ _ _ _ _ _ _ T. RAJANI , J July 13, 2018 LMV
