THE HONOURABLE SRI JUSTICE T.VINOD KUMAR W.P.No.21043 of 2019 ORDER:

This writ petition is filed seeking to declare the acts of respondents more particularly respondents 5 and 6 in illegally locking the premises bearing H.No.11-1-778/1/1/A II and III floor and H.No.11-1-778/1/1/A/1, I and II Floor of building known as Razzack Manzil, Chilkalguda, Secunderabad and insisting the petitioner to settle the issue with the 6th respondent as illegal and unconstitutional and consequently to direct the 5th respondent not to take any coercive steps against the petitioner Society and insist for settlement with the 6th respondent.

Heard the learned counsel on either side and perused the material on record.

The learned Assistant Government Pleader for Home, based on the written instructions dated 24.09.2019 of Sub-Inspector of Police, Chilakalguda Police Station, submits that one Mohammed Abdul Aleem, who is respondent No.6 in the present writ petition gave a complaint to the Inspector of Police, Chilkalguda on 17.09.2019 stating that one M.A.Karim is not allowing him to enter in his portion and also threatened him with dire consequences. On receipt of above complaint, GD entry was made and enquiry was being done.

While so, one Asma Talat gave a complaint stating that one Aleem has illegally trespassed into her house, abused her in filthy language and threatened her. On receipt of above complaints, GD entry was made and enquiry was being done. On an enquiry on both the complaints it is disclosed that a case was there between both the parties in the Court and as such advised both the parties to approach the Court of law as the matter is civil in nature. Further, he also submitted that apart from causing enquiries, the respondent Police never interfered in the above said issue and never locked the premises of the petitioner.

In that view of the matter, recording the said submission of the learned Assistant Government Pleader for Home, this writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
