THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 5881 of 2022 ORDER:

This Criminal Petition is filed under Section 437 & 439 of the Code of Criminal Procedure,' 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/A7 on bail in connection with Crime No.41 of 2022, on the file of Cherla Police Station, BhadradriKothagudem District, registered for the offences punishable under Sections 489(A), 489(B), 489(C), 489 (D) read with 120 (B) of Indian Penal Code.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that several accused were apprehended for printing counterfeit currency notes. In the process, the Investigating Officers have seized monitor, key board, counterfeit currency and printers from other accused. However, as far as the allegation against this petitioner is that he was in possession of 50 counterfeit currency of Rs.500/- and the same were seized. As seen from the Remand Report, there is no allegation of printing by this petitioner. However, the allegation against this petitioner is of circulation.

Learned Assistant Public Prosecutor on instructions submits that there are no other cases pending against this petitioner. 5.

In the said circumstances, this petitioner can be released on bail subject to the following conditions:

i. The petitioner/A7 is directed to be released on bail on his executing personal bond for Rs.25,000/-(Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of Principal District and Sessions Judge, Bhadradri-Kothagudem.

ii. On such release, the petitioner/A7 shall appear before the concerned Station House Officer on every Monday between 10.30 a.m. to 1.00 p.m. for a period of three months or till filing of charge sheet whichever is earlier, for the purpose of investigation.

iii. The petitioner/A7 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. 6.

Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
