HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.337 of 2017 ORDER :
This criminal petition is filed to relax the condition imposed by the Metropolitan Sessions Judge-cum-Special Judge to Try the Offences Under NDPS Act, Visakhapatnam, while releasing the petitioner/accused on bail for the offence punishable under Section 8(a), 20(b)(ii)(a) of NDPS Act in Crime No.19 of 2016 of Anakapalli Town Police Station, directed the petitioner to execute a personal bond for a sum of Rs.1,00,000/- with two sureties and the sureties shall furnish fixed deposit for a sum of Rs.1,00,000/- each to the satisfaction of the V Metropolitan Magistrate, Anakapalli, and also directed to furnish the attested copies of Aadhar Cards subject to verification of genuineness he shall be released with other normal conditions.
Now, the contention of the petitioner is that the petitioner is from a tribal area, who is not in a position to furnish fixed deposits of Rs.1,00,000/- each.
The total quantity of contraband involved in the offence is 14 kgs. Taking into consideration of the quantum of contraband, the condition of "sureties shall furnish fixed deposit for a sum of Rs.1,00,000/- each" is only modified as "sureties shall furnish personal bonds for Rs.1,00,000/- each to the satisfaction of V Metropolitan Magistrate, Anakapalli".
