THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.5753 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who are arrayed as Accused Nos.2 and 3 in the event of their arrest in Crime No.466 of 2022 on the file of Station House Officer, Medchel Police Station, Cyberabad, registered for the offence punishable under Sections 306 and 498-A of Indian Penal Code.

Heard learned counsel for petitioners/Accused Nos.2 and 3 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The case of the prosecution is that the deceased was married to Accused No.1 on 06.04.2022. At the time of marriage Rs.6,00,000/- cash and two tulas of gold was given as dowry. After the marriage the couple led their normal marital life for a period of 10 days. However, Accused No.1 along with his family members started harassing the deceased stating that she was forcibly married to Accused No.1. On 29.05.2022 at about 10.00 PM Accused No.1 called his father-in-law stating that the deceased was quarreling with

him for not taking her to park. Thereafter at 11.00 AM the sister of Accused No.1 again called the de facto complainant and informed that the deceased committed suicide.

Learned counsel for the petitioners submits that the petitioners are sister and mother of Accused No.1 and specifically it is not mentioned in the complaint as to how these petitioners were complicit in harassing the deceased. However, the allegation is made that these petitioners along with Accused No.1 harassed the deceased.

In the said circumstances, accused No.1 was already arrested and is in jail. These petitioners who are sister and mother of Accused No.1 against whom there are no specific allegations, can be granted the relief the anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.2 and 3 shall be enlarged on bail in the event of their arrest subject to the following conditions: i) The petitioners/Accused Nos.2 and 3 are directed to surrender before the Station House Officer, Medchel Police Station, Cyberabad within one week from today, and on such surrender, they shall be

enlarged on bail on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.2 and 3 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of two (02) months or until filing of charge sheet whichever is earlier.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
