HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.2494 of 2017 O R D E R:

The writ petition is filed challenging the action of the respondents 2 to 4 in not taking any action pursuant to the complaint lodged by the petitioner on 26.08.2016.

2. A reading of the complaint discloses that the petitioners were assigned a piece of land by the Tahsildar, Kukatpally and they are in possession of the same. The 5th respondent came to the site and tried to dispossess them. He also threatened the petitioners to vacate the same. The said complaint was got enquired by the 4th respondent and during the enquiry, the husband of the 1st petitioner stated that they would settle the matter amicably before the concerned civil court.

3. Now the learned counsel for the petitioners submitted that after the said complaint, the 5th respondent damaged the shed situated on the land and he started construction therein. If that is so, it is open to the petitioners to lodge a complaint to the 4th respondent afresh. It is needless to observe that the 4th respondent shall register the complaint and take action against the accused in accordance with law.

4. The writ petition is, accordingly, disposed of. No order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
