HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1487 of 2015 ORDER:
This revision is preferred challenging the order dated 08-07-2015 passed in C.C. No.794 of 2015 by the X Additional Chief Metropolitan Magistrate, Secunderabad, wherein the learned Metropolitan Magistrate issued N.B.W.
against petitioners/accused while taking cognizance for an offence under Section 468 read with Section 34 I.P.C. and Section 120-B I.P.C.
The learned counsel for the petitioners submitted before this Court that petitioners are ready to face the trial and they will not flee from the hands of justice. Having heard the learned counsel on either side and perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions :
The petitioners/accused are directed to appear before the Court concerned and file a petition to recall the warrant issued against them and on such filing of a petition, the trial Court is directed to recall the warrant on the same day on their execution of bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety for a like sum each and further the petitioners are
directed to appear before the trial Court regularly. Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
