THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25243 of 2015 ORDER:

Heard the learned counsel for petitioner, the learned Government Pleader for Civil Supplies for respondents 1 & 2 and the learned Standing Counsel for respondents 3 & 4.

The petitioner is a Stage-II Contractor for transport of PDS commodities from Mandapeta MLS point to three mandals viz., Mandapeta, Alamuru and Kapileswaram. The fourth respondent issued a tender notice on 23.03.2015 calling for tenders for transport of PDS commodities and the auction was conducted on 31.03.2015. In the meanwhile, the tender of the petitioner, which expired on 31.03.2015, was extended upto 30.09.2015 on the same terms and conditions under which original agreement was entered. When the third respondent allotted Mandapeta Mandal under Mandapeta MLS point to the fifth respondent to commence transportation from 01.07.2015, the present writ petition was filed.

3. This Court, by order dated 12.08.2015, granted interim suspension of the order dated 27.06.2015 transferring Stage-II SC beneficiary of Kadiyam Mandal to MLS point, Mandapeta Mandal.

Now, WVMP.No.3260 of 2015 is filed seeking vacation of that order. After hearing of the writ petition, it is agreed by the learned Standing Counsel that since there was an order of extension upto 30.09.2015, the petitioner may be continued to transport the commodities on the same terms and conditions of his original agreement upto 30.09.2015.

4. In view of the same, the writ petition is allowed by directing the respondents to continue the petitioner, pursuant to the proceedings of the third respondent dated 29.06.2015, upto 30.09.2015. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
