HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.2501 of 2015 in Crl.P.No.12909 of 2014 and Criminal Petition No.12909 of 2014 COMMON ORDER:

The defacto complainant and her counsel Sri K.Narsi Reddy are present. A.1 to A.3 and their Counsel Sri Alladi Ravinder are present. The defacto complainant filed DVC No.32 of 2014 before the Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate, Kukatpally against the accused and the same is pending While-so, both parties and their counsel present in Court today and submitted that at the intervention of elders, they have amicably settled their disputes, as per which, the defacto complainant and A.1 agreed to obtain divorce and in fact a divorce application was already filed and pending and the maintenance claim of the defacto complainant is taken care and A.1 agreed to pay Rs.1,90,000/- to her in two installments. Today he is paying Rs.90,000/- by way of two demand drafts i.e, D.D.No.046678 and 046679 for Rs.

45,000/- each drawn on ICICI Bank, Shivaji Nagar Branch, Pune and he will pay the balance amount of Rs.1,00,000/- on obtaining the divorce and hence the defacto complainant has no objection for quashment of the proceedings in DVC No.32 of 2014 on the file of Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate, Kukatpally and therefore, this Court may be pleased to accord permission to compound the offence and quash the proceedings in the interest of justice.

Having regard to the above said submission of the parties and in view of the fact that it is a matrimonial matter wherein the parties have amicably settled their disputes and also considering that no useful purpose will be served even if the parties are driven to trial and following the decision reported in Gian Singh v.

State of Punjab and another, this petition is allowed and permission is accorded to the parties to compound the offence and consequently proceedings in DVC No.32 of 2014 on the file of Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate, Kukatpally are hereby

quashed.

In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
