HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.13372 OF 2015 O R D E R:- Challenging the action of the respondents in not considering the representations dated 15.12.2014 and 20.04.2015 of the petitioners and threatening them to evict from their lands situated in Sy.No.342 and 343, Nemalipuri Village, Rajupalem Mandal, Guntur District, without issuing any prior notice, the present writ petition is filed.
It is the case of the petitioners that the 4th respondent-Tahsildar, issued pattadar pass books and title deeds in favour of the petitioners 1 to 3 over an extent of Ac.1.98 cents, Ac.1.25 cents and Ac.1.28 cents respectively situated Sy.No.342 and 343, Nemalipuri Village, Rajupalem Mandal, Guntur District and they have been eaking out their livelihood by doing agricultural works raising crops. While so, when one third party by name Ramesh threatened the petitioners to vacate them from the above said lands on the ground that he was issued a patta for the above said lands, the petitioners submitted representations dated 15.12.2014 and 20.04.
2015 to the 3rd respondent-District Collector stating that they are cultivating the said lands since their ancestors and the revenue authorities issued pass books in their favour in respect of the above said lands and requested the authority to cause enquiry and do justice. But, the 3rd respondent-District Collector did not choose to take any steps to dispose of the said representations so far. Hence, the present writ petition. The learned counsel for the petitioners submits that even though the petitioners submitted representations dated 15.12.2014 and 20.04.
direct the 3rd respondent to dispose of the representations of the petitioners. Having regard to the facts and circumstances of the case and especially in view of the limited grievance of the petitioners, the writ petition is being disposed of without expressing any opinion on merits with a direction to the respondentsauthorities to dispose of the representations dated 15.12.2014 and 20.04.2015 of the petitioner, in accordance with law, within a period of six weeks from the date of receipt of copy of this order.
