THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.9571 of 2016 ORDER:

This criminal petition is filed under Section 482 of Cr.PC to quash the proceedings against the petitioner/A1 in C.C. No.149 of 2015 on the file of the Court of Additional Judicial Magistrate of First Class, Bobbili.

2. The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the Criminal Petition with liberty to avail all the remedies available to him under law. He submitted that the trial Court issued N.B.W against the petitioner on 11.09.2015. He further submitted that the petitioner is taking treatment in Gandhi Hospital, Hyderabad.

3. Taking into consideration the health condition of the petitioner, the execution of the NBW is suspended upto 04.8.2016. If the petitioner files petition under Section 70(2) Cr.P.C., to recall the NBW issued against him, the trial Court is hereby directed to dispose of the petition on the same day in accordance with law.

4. With the above direction, the Criminal Petition is dismissed as withdrawn granting liberty as prayed for. Miscellaneous petitions, if any pending in this criminal petition shall stand closed. __________________________ T.SUNIL CHOWDARY, J.
