HONOURABLE SRI JUSTICE P. KESHAVA RAO I.A.No.1 of 2021 AND CRIMINAL REVISION CASE No.617 of 2020 ORDER:
The present Criminal Revision Case is filed under Section 397 Cr.P.C. against the interim maintenance granted to the 1st respondent in Crl.M.P.No.2 of 2020 in Crl.M.P.No.223 of 2019 in M.C.No.62 of 2019, dated 08.12.2020, on the file of the Judge, Family Court-cumVI Additional Sessions Judge, Khammam. 2.
This Court, after hearing both the parties, on 05.02.2021 passed the following order in I.A.No.2 of 2020:
"Heard the learned counsel for the petitioner as well as respondent No.1.
Learned counsel for respondent No.1 submits that the petitioner is not paying the maintenance as awarded by the Court below and literally respondent No.1 is starving and on the roads.
Keeping the said submission into consideration, there shall be a direction to the petitioner to pay the maintenance regularly to respondent No.1 apart from depositing the arrears of maintenance accrued as on today, within a period of four weeks from today.
Failure to comply with the above order, respondent No.1 is at liberty to take appropriate steps for recovery of the amount as per law.
Post on 05.03.2021.

Thereafter, the petitioner has come up with the present application i.e., I.A.No.1 of 2021 seeking modification of the above said order.

Learned counsel for the 1st respondent submits that the petitioner may be directed to give an undertaking that he will pay the monthly maintenance regularly without any default and also pay a sum of Rs.1,00,000/- (Rupees one lakh only) towards arrears of maintenance within a period of four weeks from today. 5.
Having heard both the counsel and from the perusal of the material on record, the petitioner is directed to pay the monthly maintenance regularly, apart from paying the arrears of maintenance accrued as on today, within a period of four weeks from today. Failure to comply with this order, the 1st respondent is at liberty to move an appropriate execution petition for recovery of the said amount.

With the above said direction, I.A.No.1 of 2021 as well as the criminal revision case are disposed of.
