V. Krishna Reddy, v. The State Of Andhra Pradesh, Rep. By Its Principal Secretary
HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY W.P.No.18671 OF 2016 ORDER :
The case of the petitioner is that he has purchased part of the lands in Sy.Nos.61/1 and 65/A of Piler Revenue Village. That the petitioner's predecessors in title purchased the lands in question and other lands in Court auction of District Munsif, Madanapalle, on 31-12-1932.
2.
The grievance of the petitioner is that when the document in respect of the lands in question is presented for registration, the 5th respondent-Sub-Registrar, Piler, kept the document pending on the ground that the lands are included in the list of Government lands and insisting to obtain NOC from the revenue authorities. Hence, this writ petition.
3.
Heard learned counsel for the petitioner and the learned Assistant Government for Revenue for the respondents. 4.
Learned counsel for the petitioner submits that in similar fact situation, this Court in WP No.14238 of 2011 and batch directed the Sub-registrar, Pilar, to admit the documents without treating the lands as Government lands for the limited purpose of registration and the registration of the document should not effect the rights of parties who are not parties to the transaction. This submission of the learned counsel for the petitioner is not disputed by learned Assistant Government for Revenue.
5.
In the circumstances, this writ petition being similar is also disposed of in terms of and for the reasons stated in the order passed in WP No.14238 of 2011 and batch, dated 12-03-2012. A copy of the order in the said writ petition be annexed with this
order. Miscellaneous petitions, if any, pending in this writ petition, shall also stand disposed. There shall be no order as to costs. __________________________ A.RAJASHEKER REDDY, J Dated: 01.09.2016 NRG
