HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.19127 of 2004

ORDER

The petitioners claim that they are ex-service men and are entitled to be granted Ac.5-00 of land (under relevant GOs issued from time to time) and that they are in possession of land in Sy.Nos.203, 168/pt, 706/p, 706/3, 758/2, 743, 742, 744, 745, 741, 742, 240 & 243 of Jawahar Nagar Village, Shameerpet Mandal, Ranga Reddy District, from 1965 onwards. However, in spite of the same, no assignment orders and no patta certificates were granted in their favour. Hence, the Writ petition.

It is the contention of the petitioners that similarly situated persons were granted pattas pursuant to the orders passed by this Court in W.P.No.3912 of 1992 and 5412 of 2004 and batch, dated 25.03.2004 and that they are also similarly placed persons and that they are entitled to be considered on par with them.

Though the writ petition was filed in the year 2004, unfortunately, there is no counter-affidavit filed by the respondents. Learned counsel for the respondents seeks time for filing counter. However, this Court is not inclined to grant further time, inasmuch as the prayer of the writ petition is only a

direction to the respondents to consider the cases of the petitioners in accordance with law.

In the facts and circumstances of the case, the respondents shall consider the eligibility of the petitioners for assignment of land and grant of pattas in accordance with the government orders issued from time to time. Such exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
