The Writ Petition is filed complaining inaction on the part of the official respondents against the 5th respondent for making illegal constructions.
After filing this Writ Petition, a counter-affidavit was filed stating that after issuing notice to the 5th respondent and after considering the explanation, the unauthorized construction has been demolished. However, the 5th respondent thereafter had made a proper Application, hence, permission for making construction has been granted.
Learned counsel for the petitioner seeks liberty to challenge the permission granted in favour of the 5th respondent. The grievance, which the petitioner has made, having been redressed, nothing survives in this Writ Petition and it is closed with liberty to the petitioner to exercise his rights with respect to the alleged permission granted in favour of the 5th respondent in accordance with law, if he is otherwise aggrieved. No costs. Consequently, the miscellaneous Applications, if any shall also stand closed.
