Hemi , Humi Ramavath v. M.A. Gaffore And Another
THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD MACMA NO. 1513 of 2006 JUDGMENT:
This appeal is filed by claimant aggrieved by the order and decree dated 12.04.2006 in O.P.No.1031 of 2004 passed by the Motor Vehicle Accidents Claims Tribunal-cum-XIII Additional Chief Judge, City Civil Court, Hyderabad (for short 'the tribunal). Learned standing counsel for insurance company vehemently opposed for enhancement of claim since the claimant has not filed any proof of income, proof of medical expenses and also not examined the doctor, who treated the claimant in support of the claim.
The tribunal after examining PW.1 and marking Exs.A1 to A.4 on behalf of the claimant and marking Ex.B.1-insurance policy and there is no oral evidence, passed the reasoned order. Therefore, the order passed by the tribunal is well considered and needs no interference of this Court in all aspects and hence, the appeal is liable to be dismissed.
In view of the above, the appeal is dismissed. There shall be no order as to costs.
Miscellaneous petitions if any, shall stand closed. _______________________ T.AMARNATH GOUD,J Date: 09.12.2019 kvrm
