THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.1631 of 2009 ORDER:

This Writ Petition is filed challenging the action of the respondents in not taking any action on the representation, dated 12.01.2009, of the petitioner, as illegal and arbitrary.

2. Heard both sides.

3. Though the representation was made in the year 2009 seeking payment of balance of compensation payable to the petitioner in terms of G.O.Ms.No.1307, Revenue, Assignment (I) Department, dated 23.12.1993, no action has been taken in spite of the order passed by this Court on 03.02.2009 in W.P.M.P.No.2066 of 2009, while issuing notice in the writ petition.

4. Learned Government Pleader for Revenue submits that the said representation was never received by the respondents though the petitioner submits that the representation was made and it was received by the respondents in the year 2009 itself.

5. Without going into the merits of the case and having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the 2nd respondent to consider the representation, dated 12.01.2009, of the petitioner, if the same is available in the office and pass appropriate orders within four (4) weeks from the date of receipt of a copy of this order in accordance with law, or in alternative, the petitioner herein shall make a fresh representation seeking payment of balance compensation amount within one week from the date of receipt of a copy of this order and thereafter, the authorities shall pass orders within five (5) weeks, after hearing both parties. There shall be no order as to costs. Miscellaneous
