THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9824 OF 2017 ORDER:

This writ petition is filed challenging the action of the respondents 6 to 8 in repeatedly calling the petitioner to appear before them and insisting the petitioner to vacate the agricultural landed property admeasuring Acs.3.24 guntas in survey No.518 of Wadaigudem Revenue Village in Bhongir Mandal of Nalgonda District, without therebeing any authority of law. Learned Government Pleader, on the basis of the written instructions, submits that basing on the complaint lodged by the ninth respondent, a case in crime No.3 of 2017 was registered on 04.01.2017 against the petitioner and the same is under investigation. Earlier also, the ninth respondent lodged a complaint on 30.12.2016 before the Commissioner of Police, Rachakonda.

During the course of investigation, the petitioner was asked to submit his ownership documents and instead of cooperating with the investigation, the petitioner filed the present writ petition. A representation is filed by the petitioner before the Commissioner of Police on 24.02.2017, on identical averments made in the present writ petition, and the matter was directed to be enquired by the Circle Inspector of Police, Bhongir Rural and the enquiry is in progress. It is also submitted that the sixth respondent was transferred from Bhongir Rural Police Station to Kamareddy District. In view of the same, this writ petition is disposed of giving liberty to the petitioner to approach the Commissioner of Police, to whom he already submitted representation on 24.02.

2017 and ascertain the result of the enquiry pursuant to the said representation. However, the petitioner shall cooperate with the police in the investigation of crime No.3 of 2017. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 17.04.
