THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 35436 OF 2016 O R D E R :

This Writ Petition is filed seeking a mandamus declaring the inaction on the part of Respondents 1 to 4 in considering the claims of the petitioners to the lands owned and possessed by them as assignees, by extending them the benefits in terms of the provisions of the Andhra Pradesh Capital City Land Pooling Scheme (Formulation and Implementation) Rules, 2015, as illegal and arbitrary.

Sri D. Ramesh, learned Standing Counsel for Respondents 2 and 3, on instructions, would submit that the petitioners have been claiming Respondents 1 to 4 to consider their lands in the category of 'Jareebu lands' and claimed ownership as original assignees. Since the original assignees were not in possession and enjoyment of the land and there is no need to inquire the cases under Prohibition of Transfer Act (POT Act 9/77), the matter was referred to Tahsildar, Thullur for taking action. The consent applications under 'Land Pooling Scheme' would be processed soon after a report is received from the Tahsildar, Thullur and with regard to Jareebu lands, the claims would be referred to the District Collector, Guntur to refer the matter to the Committee as per the guidelines issued in G.O.Ms. No. 165 MA & UD (CRDA-2) Department, dated 25.06.2016. In the light of the specific instructions on behalf of Respondents 2 and 3, the learned Standing Counsel assures that the cases of the petitioners would be considered and processed in accordance with law, wherever

their cases deserve such consideration and hence, no further orders are needed to be passed in this Writ Petition. Recording the said submissions, the Writ Petition stands closed. The copy of the instructions produced by the learned Standing Counsel is taken on record. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
