HON'BLE SRI JUSTICE S.V. BHATT W.P.No.10094 OF 2017 ORDER:

Heard Mr.Karribasaiah for petitioner and Mr.S.D.Gowd for respondents 2 and 3.

The petitioner prays for the following relief: ".......this Hon'ble Court may be pleased to issue a Writ, order or direction especially in the nature of Writ of Mandamus or any other appropriate writ or direction declaring the action of the 2nd respondent not granting permission to proceed with the reconstruction of removed portion of parapet wall on terrace and also to permit for installation of shutter of the petitioner house bearing no. T.S. No. 2134, Plot No. 19, Ashok Nagar, Anantapur is illegal and arbitrary and violation of principles natural justice and consequently direct the respondent to grant permission and pass.............."

From the prayer it is clear that the petitioner is aggrieved by the inaction of respondents in granting permission to proceed with the reconstruction of parapet wall on the terrace of house bearing T.S.No.2134, Plot No.19, Ashok Nagar, Anantapur. Mr.S.D.Gowd, on instructions, submits that survey report is awaited and the respondents are prepared to pass final orders expeditiously.

Hence, the writ petition is disposed of directing respondents 2 and 3 to consider the request of petitioner for reconstruction of parapet wall within four weeks from today and pass orders without fail. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any pending, stand closed.
