HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8839 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader appearing for the respondents.

Assailing the action of respondents 3 and 4 in threatening to seize the bore-well running in the land of the petitioner in Sy.No.379 A of Madhapur village, Bejjanki mandal, Karimnagar District, without issuing any prior notice as illegal, arbitrary and contrary to WALTA Act, the present Writ Petition has been filed. The learned Counsel for the petitioner submits that the petitioner dug the borewell in his land in Sy.No.379.A of Madhapur village and that the respondents are threatening him to seize the same without issuing any prior notice.

On the other hand, the learned Government Pleader appearing for the respondents submits that the petitioner did not take any prior permission to dig the bore-well as required under Section 10 of the Andhra Pradesh Water, Land and Trees Act, 2002 nor did he approach the authorities seeking registration of the bore-well as required under Section 8 thereof. He further submits that the present Writ petition is filed only on mere apprehension and that the respondent authorities will follow the due procedure of law as mandatory under the provisions of the Andhra Pradesh Water, Land and Trees Act, 2002 before initiating any action.

Recording the aforesaid submissions of the learned Government Pleader, this Writ Petition is closed. However, the petitioner is at liberty to approach the respondent authorities seeking registration of the bore-well in question. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence.
