HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10908 OF 2017 ORDER:
This Writ Petition is filed seeking two reliefs, the first relief, being the family member of Sri Thallapaka Annamacharya, composer and singer of various hymns of Lord Venkateswara, to be considered as a member of Trustee Board of respondent No.2 - Temple; and the second relief is to allot land for establishment of Annamacharya Ashram.
Heard the learned counsel for the petitioner and Smt P.Sundari, learned Standing Counsel for respondent No.2 - Temple.
In so far as the first prayer is concerned, power to constitute Trust Board vests with the Government in terms of Section 96 of the A.P.Charitable and Hindu Religious Institutions and Endowments Act, 1987 (Act 30 of 1987). Inasmuch as petitioners have not made the Government of Andhra Pradesh as a party respondent, the first relief, of the nature, which they seek cannot be granted .
In so far as second relief is concerned, inasmuch as the petitioners made representations dated 05.07.2016 and 13.12.2016, respondent No.2 shall consider the same, limited to the extent of feasibility of allotting piece of land
subject to the existing schemes and rules, within a period of three months from the date of receipt of a copy of this order.
Subject to the above observations, the Writ Petition stands disposed of.
Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
