HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.13952 of 2016 ORDER :
This Criminal Petition, under Section 482 of Cr.P.C., is filed by the petitioners, who are A.1 to A.3, seeking to quash the proceedings in C.C.No.255 of 2015 on the file of XIV Metropolitan Magistrate, L.B. Nagar, Cyberabad, Ranga Reddy District, for the offences punishable under Sections 498-A and 506 of IPC.

Heard learned counsel for the petitioners as well as the learned Public Prosecutor and perused the material on record.

The facts would reflect that the marriage between 1st petitioner and 1st respondent had taken place on 12.05.2001 and they lead a happy marital life till 2015 and thereafter, they got a child and then only differences arose between the petitioners and the 1st respondent in relation to the issue of performing the Naming Ceremony of the child in accordance with Christianity in a Church, which was refused by the 1st petitioner. That has been the reason, according to the learned counsel, the petitioners were falsely implicated in the said crime.

According to the learned counsel, C.C.No.255 of 2015 is coming up for framing of charges.

As seen from the material on record, at this stage, it is not a case for quashing the charge sheet. However, the presence of the petitioners - A.2 and A.3, who are sister and mother, respectively, of the 1st petitioner and who are residing in Guntur, but not in Hyderabad, is dispensed with during trial. However, they shall appear before the learned Magistrate at the time of framing charges, with a further direction that they shall also appear as and when directed by the learned Magistrate. It would be reasonable to direct the learned Magistrate to frame charges within three months from the date of receipt of a copy of this order.

Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
