THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7570 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 to 3 seeking anticipatory bail in the event of their arrest in connection with Crime.No.210 of 2023 on the file of Suryapet I Town Police Station, Suryapet District, registered for the offence under Section 306 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The complaint was filed on 08.07.2023 by the mother of the deceased stating that earlier a complaint was filed by the petitioner No.1 against the deceased. Thereafter, the deceased was released on bail one day prior to his death. It is stated in the complaint that on account of the harassment of these petitioners, he committed suicide.

Learned counsel for the petitioners would submit that on account of harassment by the deceased, the complaint was lodged by petitioner No.1 on 07.06.2023 and crime was

registered against the deceased for the offences punishable under Sections 354-D, 504 and 506 of Indian Penal Code. 5.

Except stating that a criminal complaint was filed, there is nothing in the complaint to suggest that there was any kind of acts of abetment and forcing the deceased to commit suicide. In the said circumstances, this Court deems it appropriate to grant relief of anticipatory bail to the petitioners subject to the following conditions;-

1) The petitioners/Accused Nos.1 to 3 are directed to surrender before the Station House Officer, Suryapet I Town on 21.08.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.1 to 3 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.1 to 3 shall appear before the concerned police as and when required for the purpose of investigation.

3) The petitioners/Accused Nos.1 to 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
