THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.26535 OF 2007 ORDER:

This writ petition is filed seeking a writ of mandamus declaring the action of the respondents in threatening to demolish the houses of the petitioners without any notice and without following due process of law, constructed on the respective plots mentioned in house pattas given by the 3rd respondent in RC No.34/90/P/N in Sy.No.27, Madhurawada, Visakhapatnam Rural as illegal and arbitrary and consequently, direct the respondents not to demolish the houses of the petitioners. Ms.Vasantha, learned Assistant Government Pleader for Revenue, referring to para 3 and 4 of the counter affidavit filed by the 3rd respondent, submitted that the Mandal Revenue Inspector and Village Revenue Officer inspected the subject-lands and found that no one is residing therein and the whereabouts of the petitioners is also not traceable.

Considering the above, the writ petition is dismissed granting liberty to the petitioners to move the Court as and when fresh cause of action arises and in the event of any demolition activity is proposed by the respondents, the same shall be taken up by following due the process of law. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
