HONOURABLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No. 1375 of 2018 ORDER:
Heard the learned counsel for the petitioner as well as the respondents.
The present criminal revision case is filed aggrieved by the orders dated 02.05.2018 in Crl.M.P.No.71 of 2018 on the file of the learned V Additional District and Sessions Judge, Medak at Sanga Reddy dismissing the petition for release of car bearing No. AP-29-AA-0707 in favour of the petitioner.
The facts of the case are that the subject vehicle was seized by the police after commission of the offence. Pending the crime, the petitioner filed a petition in Crl.M.P.No.71 of 2018 seeking interim custody of the subject vehicle. However, the said petition was dismissed by the learned V Addl.District and Sessions Judge, Medak at Sangareddy by orders dated 2.05.2018. Aggrieved by the same, the present criminal revision case is filed.
Learned counsel appearing for the petitioner would subject that the petition was dismissed on the ground that the investigation is pending. Learned counsel also brought to the notice of the court that the investigation is completed and charge sheet is also filed. Learned Public Prosecutor has not opposed the case of the petitioner on the ground that the investigation is completed and charge sheet is filed. However, he submits that the subject vehicle may be released subject to furnishing of third party surety.
Having regard to the facts of the case, the order dated 02.05.2018 in Crl.M.P.No.71 of 2018 on the file of the learned V Additional District and Sessions Judge, Medak at Sanga Reddy is set aside and the vehicle car bearing No. AP-29-AA-0707 is ordered to be released subject to furnishing of third party surety for a sum of Rs.3,00,000/ - (Rupees three lakhs only). The petitioner shall give undertaking to the effect that he shall not sell, alter or change the colour of the vehicle. The petitioner is further directed to produce the vehicle as and when required by the Court below. With the above said observations, the criminal revision case is disposed of.
The miscellaneous petitions, if any, pending in this criminal revision case shall stand closed.
