HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.25010 of 2003 ORDER :

This writ petition is filed seeking a Writ of Mandamus declaring the action of respondents in not appointing the petitioner on compassionate ground on par with similar persons whose lands were acquired by the Devastanam, is arbitrary and illegal and consequently to set aside the proceedings, dated 24.01.2002. Heard Smt. S.V.Indira, learned counsel for petitioner and the learned Government Pleader for Endowments, appearing for respondents.

It has been contended by the petitioner that the respondents have acquired the land of petitioner's family and promised to provide employment to one of the family members. The petitioner has submitted an application seeking appointment on the ground that the lands of several persons were acquired by the Devastanam and the respondents have given appointment to various other individuals, but when it came to the petitioner, the respondents denied employment. Challenging the action of respondents in not providing employment to the petitioner, the present writ petition is filed.

Learned Government Pleader appearing for respondents has contended that the case of petitioner was considered and the same was rejected vide proceedings dated 24.01.2002, as the petitioner is

not entitled for employment and there are no vacancies to AKS, J W.P.No.25010 of 2003 accommodate the petitioner. There are no merits in the writ petition and the same is liable to be dismissed.

This Court, having considered the rival submissions of the parties, is of the considered view that this writ petition can be disposed of directing the respondents to re-consider the case of the petitioner without being influenced by the rejection orders dated 24.01.2002 and pass appropriate orders within four weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
