Heard learned counsel for the petitioners and Sri M.Ravindra, learned Standing counsel for the respondents. 2.

On 20.05.2016 alleging theft of electricity, provisional assessment was made demanding the petitioners to pay Rs.2,04,539.05 paise, pending determination of civil liability by the appropriate Court under Section 154 (5) of the Electricity Act, 2003 (for short 'the Act') and the power supply was disconnected.

This court by order dated 22.06.2016 directed restoration of power supply to Service Connection No.1412331001008693, subject to petitioners paying 1/3rd of the demanded amount as a condition precedent.

It is now informed that the power supply is restored on payment of 1/3rd of the demanded amount and power supply is continuously provided.

Learned Standing counsel, informs the Court that the proceedings are still pending before the Special Court. 6.

In view of the same, the respondents are directed not to take any coercive action against the petitioners till the proceedings are concluded by the Special Court under Section 154 (5) of the Act, subject to petitioners continue to pay electricity charges and are not involved in any other allegations of theft or violation of the terms and conditions of power supply.
