HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.24901 of 2017 ORDER:

No representation for petitioner on 04.10.2017, 31.10.2017 as well as today.

The petitioner prays for the following relief :- " .... to issue a Writ, Order or Direction(s) more particularly, one in the nature of Writ of Mandamus declaring the action of the 3rd and 4th Respondent in calling the Petitioner to police station is illegal, arbitrary and in violation of fundamental rights guaranteed under Articles 14, 16, 21 and 300-A of the Constitution of India and consequently direct the 3rd and 4th Respondent not to call the Petitioner to the police station......" .

Learned Assistant Government Pleader (Home), basing on written instructions, dated 01.08.2017, submits that a case in Cr.No.291 of 2017 was registered against the petitioner on 22.07.2017 for the offences punishable under Section 504 IPC and Section 3(1)(r)(s) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 2015, and the 3rd respondent by following the guidelines of the Hon'ble Supreme Court in LA LITHA KUM A RI Vs. G O VERNM ENT O F U.P. & O THERS1, would enquire into the matter and proceed with the investigation. 1 (2014) 2 SCC 1

The statement is placed on record.

The writ petition is dismissed accordingly. No order as to costs.
