HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24819 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents in seeking to acquire land and structures covered in D.No.7/1544 & D.No.7/1545 belongs to the petitioner, situated abutting to Korrapadu Road, Proddutur, Kadapa District, for the purpose of widening of road from 60 feet to 100 feet, without initiating proceedings under Land Acquisition Act, without paying compensation, as illegal and arbitrary and for a consequential direction to the respondents not to acquire the aforesaid lands of petitioner without paying the compensation.

Heard learned counsel for the petitioner who submits that in similar circumstances this Court disposed of WP.No.32679 of 2015, dated 07.10.2015, and the same is not disputed by Sri MD.Saleem, learned Standing Counsel appearing for the 2nd respondent. In view of the above, this writ petition is disposed of in terms of the order dated 07.10.2015, passed by this Court in WP.No.32679 of 2015, directing the respondents 2 to 4 to follow due process of law, if the petitioner's land is required to be acquired for public purpose and accordingly pay appropriate compensation to the petitioner. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
