Order:

This Company Petition is filed for an order to wind up the respondent- Company for non-payment of the debt due to the petitioner.

At the hearing, Mr.B.Nalin Kumar, learned Counsel for the respondent, submitted that in pursuance of settlement of dispute with the petitioner, the respondent has agreed to pay a sum

of Rs.7,50,000/- as full and final settlement of the petitioner's claim and that a Demand Draft has already been obtained for the said sum.

Mr.Sallori Ramesh, learned Counsel for the petitioner, submitted that the Demand Draft handed over by the learned Counsel for the respondent, shows that the same was drawn in the name of M/s.BOC India Limited, which was the former name of the petitioner, and not in the present name of the petitioner.

The learned Counsel for the respondent submitted that he will ensure that the name of the payee in the Demand Draft is changed as M/s.Linde India Limited and that the same will be handed over to the learned Counsel for the petitioner by 03.08.2015.

In the light of the fact that the parties have settled the dispute, no further adjudication of the Company Petition is necessary.

Hence, the Company Petition is disposed of as settled out of the Court.
