CVNR, J CRP 5209/2017 ORDER:

This civil revision petition arises out of order dt.24.7.2017 in R.C.A. No.5 of 2017 on the file of the Principal Senior Civil Judge-cum-Appellate Court of Rent Control Cases, at Visakhapatnam.

Mr. V. Mallik, learned counsel for the petitioners, fairly stated that against an order passed in an execution application filed in the execution petition filed by the respondent before the execution court, his clients have filed R.C.A. No.5 of 2017, which was initially entertained and interim stay was granted, and finally the said appeal was dismissed inter alia on the ground that the same was not maintainable. He has fairly brought to the notice of this Court that the view taken by the lower appellate Court is supported by the judgment of the Division Bench of this Court in Jaleel Khan v. M. Kamalamma1 wherein it was held that no appeal lies against an interlocutory order passed under Section 20 of the Andhra Pradesh Buildings (Lease, Rent and Eviction) Control Act, 1960. In the light of the aforementioned Division Bench judgment, which supports the order of the lower appellate court in all fours, this civil revision petition is dismissed. 1 2001 (5) ALD 610 (DB)

CVNR, J CRP 5209/2017 As a sequel to dismissal of the civil revision petition, C.R.P.M.P. No.6770 of 2017 shall stand disposed of as infructuous.
