HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.12041 OF 2017 ORDER:

This writ petition is filed for a mandamus declaring the action of respondent No.2, in not passing orders for release of 2280 Kgs of white jaggery, as being illegal and arbitrary.

The petitioner pleaded that, during the course of business, he sold 2280 Kgs of white jaggery and loaded in trolley bearing No.TS-01-UB-3345; and, when the said trolley reached outskirts of Mancherial Town, respondent No.3 intercepted the vehicle, seized the stock and registered the case in C.O.R. No.373/2016. The petitioner, therefore, seeks a direction to respondent No.2 to pass orders on his representation dated 23.03.2017 to release stock seized in C.O.R. No.373/2016.

Heard the learned counsel for petitioner and learned Government Pleader for Prohibition and Excise. Inasmuch as the application seeking release of seized stock is pending with respondent No.2, interest of justice would be served if a direction is issued to respondent No.2 to dispose of the petitioner's representation dated 23.03.2017 within a period of four weeks from the date of receipt of a copy of this order.

Subject to the above direction, the writ petition stands disposed of.

Consequently, miscellaneous petitions pending, if any, shall stand disposed of as infructuous. No order as to costs.
