ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise appearing for the respondents.

This writ petition is filed alleging that on the ground that the vehicle of the petitioner bearing registration No.TS 07UG 3897 is involved in COR.No.262 of 2020 under the provisions of the Telangana Prohibition Act and the Telangana Excise Act, the vehicle was seized and interim custody of the vehicle is not given to the petitioner.

When the matter is taken up, learned Government Pleader for Prohibition and Excise informs the Court that on 31.12.2020 the competent authority passed orders confiscating the vehicle. 4.

Since the vehicle is already confiscated, the question of granting interim custody of the vehicle does not arise. 5.

Leaving it open to the petitioner to avail appropriate remedies as available in law against the orders of confiscation of the vehicle, the writ petition is dismissed. It is needless to observe that if the petitioner intends to prefer an appeal and also files an application seeking grant of interim custody of the vehicle, pending the appeal, the appeal authority shall consider such application within a period of three weeks from the date of receipt of such application. Pending miscellaneous petitions shall stand closed.
