THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21349 of 2019 ORDER:

In this Writ Petition, it is the case of petitioners that they entered a Development Agreement-cum-General Power of Attorney with respondent Nos.4 to 13 with respect to their property admeasuring 1111 sq.yards situated at Lakdikapul, Hyderabad. They assert that as per the building permission granted by the municipal authorities, only three floors construction is permitted, whereas, respondent Nos.4 to 13 are constructing six floors and that as a matter of fact, they were issued notice by the second respondent - Assistant City Planner, Circle No.17, Khairatabad Zone, Hyderabad, on 27.07.2019 alleging that they are unauthorizedly raising cellar as against the sanctioned plan for stilt+3 upper floors, to which, they submitted explanation on 06.09.2019. It is their grievance that so far, the respondent authorities have not taken any action against respondent Nos.4 to 13.

Considering the nature of grievance of the petitioners and as it is stated by the petitioners that they have already submitted explanation to the notice issued by the second respondent, without going into the merits of the matter, the respondent

CKR, J W.P.No.21349 of 2019 authorities are directed to take necessary action in the matter only after taking into consideration the explanation submitted by the petitioners, and ensure that the construction is made in accordance with the sanctioned plan.

Subject to the above, this Writ Petition is disposed of. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
