THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45979 of 2016 ORDER:
This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of the respondents in not releasing the pending Grant-in-Aid for the years 2002-03, 2003-04, 2004-05 and not revival all the programs conducted by petitioner's organization as per A.P. State Government specific recommendation Letter No.2379/Bud-2/2006-3, dated 18.02.2009, as illegal and arbitrary and consequently to direct the respondents to release the pending Grantin-Aid for the years 2002-03, 2003-04, 2004-05 and revival all the programs conducted by petitioner's organization as per recommendation of State Government basing on the District Collector's Inspection Report vide Letter No.2379/Bud-2/2006-3, dated 18.02.2009. Heard and perused the material available on record.
The case of the petitioner is that the petitioner organization is registered under the name and style of "Peda Prajala SEva Samithi" under the Societies Registration Act, XXI of 1860 bearing Registration No.320/1988 and that the aims and objects of organization is to help socially and economically weaker section of society, more particularly, women and children.
Government Officials as per G.O.Rt.No.54 and released the grant-in-aid for the years 2000-2001, 2001-2002 and released 1st instalment for the year 2002-03 and that no amount was released to the Short Stay Home Programme, except sanctioned letter given by the 2nd respondent in the year 1999-2000 and that the Central Social Welfare Board has placed the petitioner's Short Stay Home for woman and girls in black list basing on the forgery signature Inspection Reports of the District Collector, Chittoor and Revenue Divisional Officer, Chittoor, in CB/1, dated 30.06.1999. The main grievance of the petitioner is that the petitioner has submitted representations, dated 16.08.2002 and 13.07.
2016, to the 1st respondent requesting to release the pending Grant-in-Aid for the years 2002-03, 2003-04, 2004-05 and revival all the programs conducted by petitioner's organization as per recommendation of State Government specific basing on the District Collector's Inspection Report vide Letter No.2379/Bud-2/2006-3, dated 18.02.2009, but so far, the same are not considered and disposed of by the 1st respondent. Considering the said facts and circumstances, the 1st respondent is directed to consider the representations, dated 16.08.2002 and 13.07.2016, submitted by the petitioner and dispose of the same, as expeditiously as possible, in accordance with law, more preferably within a period of three (3) months from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of.
No costs.
Consequently, miscellaneous petitions pending, if any, shall stand closed.
