THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20861 OF 2016 ORDER:

Heard the learned counsel for the petitioner and Sri N.Ashok Kumar, learned Standing Counsel for Greater Hyderabad Municipal Corporation (GHMC). With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2. The present writ petition came to be filed with the following prayer:

"to issue a writ, order or direction more in the nature of writ of Mandamus declaring the action of the respondents 1 and 2 in not taking action on the Complaint, dated 26-09-2012 made by the petitioner as illegal, arbitrary and violative of Article 14 and 21 of the Constitution of India and consequentially to take immediate action on the representation of the petitioner submitted to the respondents 1 and 2 and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

3. Learned counsel for the petitioner submits that the unauthorised constructions made between the house of the petitioner and the ring road, wherein a restaurant and function hall are being run by the 3rd respondent, is causing disturbance to the petitioner and his family members.

4. Learned Standing Counsel for GHMC submits that since the representation made by the petitioner is of the year 2012, the petitioner may be directed to give fresh representation, in which

event, the same will be considered as per law.

5. Having regard to the same, the Writ Petition is disposed of directing the petitioner to make a fresh representation to the authorities concerned within a period of ten (10) days from today, in which event, the same shall be dealt with, in accordance with law, as early as possible preferably within a period of six (06) weeks thereafter, after hearing the petitioner as well as the aggrieved persons, if any.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
