ORDER

This writ petition is filed challenging the action of the 3rd respondent in registering Cr.No.31 of 2016, dated 1.2.2016 against the petitioner for the offences punishable under Sections 324, 323, 509 read with 34 IPC and Section 3 (i) (x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989.

A crime was registered on 1.2.2016. Challenging registration of crime, the petitioner approached this Court. While issuing notice before admission on 6.1.2017, this Court permitted the petitioner to take out personal notice to the 4th respondent and directed the respondent-police to proceed with the investigation, without arresting the petitioner. The petitioner took out notice to the 4th respondent and notice was delivered to him on 1.4.2017 and in spite of the same, none appeared on his behalf.

In view of registration of crime on 1.2.2016 and pursuant to the order passed by this Court on 6.1.2017 directing the respondent-police to continue the investigation without arresting the petitioner, this Court sees no ground to modify

the said order. However, the 3rd respondent is directed to complete the investigation and file a final report/charge sheet within three months from the date of receipt of a copy of this order without arresting the petitioner.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 18th April, 2017 rkk
