As seen from the record, though the 1st respondent expired and an endorsement to that effect was made even in the year 2006 itself, still steps were not pursued to bring his legal representatives on record. Even at the request of learned counsel for the appellant on 10-02-2015, the matter is listed to this day, but there is no representation for the appellant.

Therefore, the appeal is dismissed for nonprosecution. There shall be no order as to costs.
