THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.41560 of 2015 ORDER:

The grievance of the petitioner is with regard to the location of an A4 shop opposite his shop by the fifth respondent. The petitioner submitted a representation in this regard to the Superintendent, Prohibition and Excise Department, Proddatur, YSR Kadapa District, which was received on 02.12.2015 as is borne out by the endorsement thereon.

As the said representation is still pending consideration before the authority concerned and as the learned Government Pleader for Excise is also agreeable to the disposal of this writ petition with a direction in that regard, this Court does not deem it necessary to put the fifth respondent on notice as no issue is being decided on merits presently.

The writ petition is accordingly disposed of directing the Superintendent, Prohibition and Excise Department, Proddatur, YSR Kadapa District, the third respondent, to consider the petitioner's representation, which was received on 02.12.2015, in accordance with the norms and take appropriate action in the matter thereafter. The third respondent shall give a hearing to the petitioner as well as the fifth respondent before taking a decision in the matter. This exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order.
