THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.18361 of 2018 ORDER:
Heard counsel for petitioner and the learned Assistant Government Pleader (Revenue).
The petitioner prays for the following relief: "...writ of mandamus declaring the action of the respondents in trying to dispossess the petitioner from the assigned land of 0.29 gts in Sy.No.182 PP of Brahmanpally Village, M.R.Anthergaon, Peddapalli Dist. belonging to the petitioner with a view to make construction of Police Station in the said assigned land without consent and without initiating any proceedings to acquire the said land as illegal, arbitrary......." To meet the ends of justice and to give fair opportunity to petitioner, the writ petition is disposed of by this order:
(a) The petitioner is given liberty to file representation before the 3rd respondent by enclosing all the originals, the petitioner has, in support of both assignment and enjoyment of an extent of Ac.0.29 gts in Sy.No.182 PP of Brahmanpally Village, M.R.Anthergaon, Peddapalli District by
enclosing copy of this order within two
(2) weeks from today.
(b) If the representation is filed as permitted by this Court, the 3rd respondent conducts enquiry into all aspects namely assignment, enjoyment, demise of petitioner's wife etc., and passes an order and communicates to petitioner within four
(04) weeks thereafter.
(c) The petitioner, if is aggrieved by the final communication, is given liberty to work out remedies in accordance with law. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
