ORDER:
Inaction of respondent Nos.1 to 4 in preventing respondent No.5 from raising illegal construction is questioned in this writ petition.
At the hearing, Sri Chatla Madhu, learned Standing Counsel for GHMC appearing for respondent Nos.2 to 4, on instructions, submitted that the Corporation has issued notices under Sections 452 and 461 of the Greater Hyderabad Municipal Corporation Act, 1955; that later orders were passed under Sections 452(2) and 636 of the said Act and that questioning the same, respondent No.5 has filed a civil suit and obtained an order of injunction.
In the light of the above facts, which are not disputed by the learned counsel for the petitioner, the writ petition is disposed of by permitting the petitioner to get impleaded in the civil suit and contest the same. The petitioner is also permitted to approach the respondents afresh in the event the suit is dismissed. As a sequel to disposal of the writ petition, WP.MP.No.30883 of 2015 shall stand disposed of as infructuous.
