The present Writ Petition, under Article 226 of the Constitution of India, is filed to declare the action of the respondents in not considering the representation dated 06.09.2016 for entering the additional qualification of Technician Membership Examination (Civil) (equivalent to Diploma) in service register even though respondent No.3 forwarded a letter vide Rc.No.345/A1/2008 dated 17.09.2016, as arbitrary and illegal, consequently direct the respondents to consider the representation dated 06.09.2016 as per the Letter No.2565/Vig.Cell-A2/2013-2 dated 16.04.2015 issued by respondent No.1.

In similar circumstances, this Court by an order dated 06.04.2017 in W.P.MP.No.9692 of 2017 in W.P.No.7861 of 2017 granted interim direction to consider the representation of the petitioners therein for entering the additional qualification acquired by the petitioners therein. The petitioner in the present case is also similarly situated and also made representation dated 06.09.2016, which is forwarded to the 3rd respondent vide Rc.No.345/A1/2008, dated 17.09.2016.

In view of the same, without expressing any opinion on merits, respondents are directed to consider the representation dated 06.09.2016 made by the petitioner and take appropriate

action in accordance with law as early as possible preferably within a period of three (03) months from the date of receipt of a copy of this order.
