The present writ petition is filed seeking a direction to the second respondent not to interfere with the peaceful possession and enjoyment of the petitioner over the land to an extent of Acs.5.00 guntas in Survey No.778 of Bojjagudem Thanda, Ananthagiri Mandal, by yielding to the pressures brought out by the third respondent herein. Heard Sri V.Brahmaiah Chowdary, learned counsel for the petitioner, learned Assistant Government Pleader for Home and Sri G.Sathish Babu, learned counsel for the third respondent. Learned Assistant Government Pleader for Home, on written instructions, dated 27.09.2019, would submit that acting on the complaint, dated 29.07.2019, made by the third respondent, stating that the petitioner herein had trespassed into to the subject land and damaged the shed and mango trees, a case in Crime No.

96 of 2019, for the offence under Sections 447, 427 read with 34 IPC, was registered against the petitioner and others. A notice under Section 41-A Cr.P.C. was served on the petitioner-A1 on 02.08.2019 and the remaining accused are absconding. Learned Government Pleader would further submit that after completion of investigation, appropriate report would be filed before the competent Court. The allegations made in the writ petition that the second respondent interfered with the life and liberty of the petitioner and also in the civil disputes and detained the petitioner in the police station, are denied. He would submit that except registering FIR and visiting the scene of offence, the second respondent did not interfere or tried to dispossess the petitioner from the above land.

Recording the aforestated submissions made on behalf of the second respondent to the effect that the second respondent neither interfered in the civil disputes nor tried to dispossess the petitioner from the land in question, except registering FIR, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
