HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18353 OF 2018 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent University in not granting the affiliation to the petitioner college for Engineering branches of CSE, ECE, Mechanical and Civil, on the ground of non availability of biometric attendance of all the requisite faculty members, as illegal and arbitrary and for a consequential direction to the 2nd respondent to grant affiliation to the above said branches as sought by the petitioners in its online application dated 23.02.2018. Heard learned counsel for the petitioner.

Sri Abhishek Reddy, learned standing counsel appearing for respondents 2 and 3 produced a copy of the Affiliation Procedure and Regulations 2018-2019 stating that as per clause 3.9 of the said regulations, Biometric attendance for faculty & PG students in all the affiliated Colleges is mandatory; that by taking the Biometric attendance of faculty as evidence, the University may initiate the punitive actions like Rejection of Affiliation for ensuing academic year or suspension/withdrawal of Affiliation for existing programs/courses. He also submits that the faculty of the petitioner college is not having minimum attendance of 50%. He also produced Note on Biometric Attendance of the faculty of the petitioner college showing the attendance of the faculty of the petitioner college less than 50%. He further submits that if

petitioner is having any proof showing that their faculty is having sufficient attendance, it is open for them to place the same before the respondent University.

Learned counsel for the petitioner submits that the petitioner college has already placed the material before the University. In view of the above it is for the respondent University to consider the said material placed by the petitioner college and take action in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
