Heard Ms.N.Niyatha for petitioner and the learned Assistant Government Pleader for Revenue.
The petitioner prays for the following relief: ".........Writ of Mandamus declaring the action of respondents in not registering the documents in respect of house bearing No.5985/61 in plot No.61 admeasuring 833 Sq.Yards in Survey No.5/3 situated at Raidurg Panmaktha Village, Serilingampally Mandal, Ranga Reddy District, as illegal, arbitrary and in violation of Articles 14, 21 and 300-A of Constitution of India. Consequently to direct the respondents to register documents in respect of house bearing No.5-85/61 in Plot No.61 admeasuring 833 Sq.Yds in Survey No.5/3 situated at Raidurg Panmaktha Village, Serilingampally Mandal, Ranga Reddy District..............."
On 06.06.2018, at request of respondents the writ petition is directed to be listed today either for filing counter affidavit or getting instructions.
The Assistant Government Pleader places on record, the written instructions dated 13.06.2018 and further submits that firstly, the petitioner has not presented the document to the registering authority for registration and secondly, the petitioner if presents the document for registration, the document so presented will be processed in accordance with law.
The statement is placed on record.
The writ petition is disposed of accordingly. However, it is made clear that this Court has not examined the merits of the matter and it is for the registering authority to verify as and when the document is presented for registration. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
